CJ Martha Koome annouces magistrate's dismissal from service over alledged gross misconduct


NAIROBI, Kenya Mar 7...The commission on diverse dates received a total of five petitions for the removal of Hon.Justice Mohamed Noor kullow from office as Judge of environment and land court for alleged violations of constitution of Kenya 2010 and judicial service conduct.

Following a panel appointed by the commision , the commision was satisfied that three out of the five  petitions as well as proceedings at the commissions own motion had disclosed grounds for the removal of Hon.Justice kullow from office  over cross misconduct , incompetence and violation of the judicial service code of conduct.

In addition the commission resolved to dismiss Hon. Patrick wambungu , principal magistrate from service for gross misconduct , Wambungu was accused of irregularly altering bond terms that resulted in the release of an accused person who had been judged with defilement of a six year old minor

Since January 2023 the commision ha received 85 petitions and complaints' against hon judges with 37 being dismissed based on merits and independence of a judge , 30 petitions are pending preliminary evaluation , 11 awaiting responses from judges concerned , 3 petitions have been admitted for hearing and 4 petitions have been forwarded to His Excellency the president for appointment of a tribunal

In the same period the commision received 4 disciplinary cases against judicial officers from office of the chief justice , Upon consideration the commision dismissed 1 judicial officer from service , 1 disciplinary case for insufficient evidence  while 2 of the cases are ingoing

"The commision wishes to assure the people of Kenya of its commitment to values of integrity and accountability in the Judiciary and reiterates its dedication to discharge its mandate in accordance with the constitution and the law" reads a statement by Judicial service commision (JSC)
